hi all,
got the problem sorted out now. it turned out that i misconfigured the php suexec in WHM. what i did was i just set the SuExec to ON, and left the PHP Handler to CGI. It should have been SuPHP as pointed out by psfrog

How did You enable phpsuexec? Do you enable "SuPHP" in WHM-panel ?
