Surpass Hosting does not allow IRC or IRC bots to be operated on our shared or reseller servers. They are allowed on dedicated servers provided that no negative effects occur to our network.

As far as I could tell from visiting the site, it's a Java IRC client that connects to a remote server. Last I saw that was perfectly acceptable to host.

You can use this so long as you understand that it must connect to a remote IRC server, unless of course you're running a dedicated server.

Is this still the case? The Acceptable Use Policy say's surpass does not provide chat rooms, but phpmychat has appeared in my cPanel.

Still the case. When ever Cpanel and Fantastico are updated, they tend to show up until removed again. See this thread that discusses it.
