Cgi-sys/formmail.pl Questions

Has anyone else been recieving rejected emails that were sent from your main account by cgi-sys/fommail.pl?
There was a patch applied to the server last month but some how someone is still sending spam from the server.
How can I stop any one from using "mydomain.com/cgi-sys/formmail.pl"
