LEGAL is the key.
Anything that gets a Surpass IP address blacklisted or generates complaints can and will be investigated by surpass staff. Even on a DEDI.

there are other 'freeware' control panels that you can use, but offering your clients Cpanel is never a BAD thing...

Im thinking about getting a Dedicated server for my own sites that will require imense amounts of space and bandwith. But if I did get CPanel would that control name servers and all of that?
