A couple of reseller questions...

I am considering a Surpass Hosting reseller account and have a few questions:

+ Do you have specific requirements for email newsletters? Do you require double opt-in? And do you consider this double opt-in: Suppose a user subscribes to a newsletter. We send them a confirmation email with a temporary password and a link to the login page where they login and immediately are asked to change their password.

+ I assume that sent-out newsletters are counted as bandwidth used. Correct?

+ Do you plan to offer Live Help in the future?

+ If I had an emergency during off hours, what kind of response time can I expect?

+ If by chance you have a hard disk crash and lose data, would you have my sites backed up and install them for me, or would I have to upload them all over again and set up the email accounts for all my clients?

1) No idea, sorry.
2)Yes, they do.
3) Live help is available via these forums, and by e-mailing supportsurpasshosting.com, 24/7.
4) It depends on if the emergency is one only you are experiencing. If the emergency is server-wide, you might not get an immediate response as things are being fixed. Support tickets generally do not take very long to be answered.
5) Backups are performed on a regular basis, and Surpass is fully capable of restoring your files and settings should the main hard drive fail.

double opt-in might be ok. Any other type is SPAM.

From the TOS:

If you choose to engage in marketing your site and/or services via email please heed the following. The only permitted form of email marketing is that in which the list is "opt-in". By definition, opt-in is where people provide you with their email address specifically requesting to be on your email list for information about your site and/or service. If we find your account trasnmitting email to persons that did not authorize such activity, that is grounds to suspend and terminate your site. Note: On the flip side, the joining of an opt-in email list does not guarantee the legitimacy of such a list. Please contact us before taking any steps so that you will not be a victim of spam from second and third parties of such lists.

UCE, UBE, Spam
Surpass Hosting.com, LLC has a zero tolerance policy regarding unsolicited commercial email (UCE) and unsolicited bulk email (UBE) also known as "spam". Spam is the act of sending unsolicited email. You will be cited with UCE/UBE abuse if you send any email to persons who have not specifically asked to receive email from you. The sending origin of such email is irrelevant. If your Surpass Hosting-hosted site is referenced in any way within such an email, then you will be cited for UCE/UBE. Upon confirmation of abuse, any Surpass Hosting.com, LLC customer engaging in this practice will have their service suspended and terminated immediately without refund. Not only does spam place a strain on the server that can negatively effect that server's uptime record and performance record, you subject that server to be blacklisted. Backup
Surpass Hosting takes extreme steps to maintain system integrity. However, Surpass Hosting shall not be held responsible for loss of data due to any cause. To ensure the highest level of data protection, Surpass Hosting recommends that ALL information be backed up on your own computer. As with any data that you hold a high importance to, it should be in more than one location at all times. All Surpass Hosting data backups are designed against hardware failure not customer user error.

OH, and one cavieat - backup your own site at least monthly, if not weekly, especially if there is a volume of data that can be lost.

The bottom line on email lists and newsletters is simple. Do everything in your power to not get spam complaints. If we starting getting complaints, we come after you. Otherwise you are fine. Double opt-in isn't required, but highly recommended as it proves a strong case if spam disputes ever come up. Kinda hard for someone to say they didn't sign up for your newsletter when they have to go through that process.

Another clarification, help via these forums is for general help only. Anything specific to your account or that requires access to your account to fix should ALWAYS be emailed to supportsurpasshosting.com.
