I still think that torrent files legal or otherwise wont be hosted. Torrent files are almost 99% illegal downloads and 1% legal. Because Surpass can't verify the integrity of all the files that they host, am sure it would be assumed that the torrents are of an illegal nature. It works on the same principal of not hosting MP3s, you might have the right to redistibute an MP3 but because surpass can't verify this they steer clear of allowing MP3s.

ilegal?

since we are in that subject.., what would happen if a client on my server had ilegal torrent files? :thinkerg:

1) Napster is a legal download source now.

2) When you say "that you never" I see your directing this to the surpass comunity. Well we dont make the rules that govern the use of Surpass's server, so that argument really falls down because whether we use kazaa or not make no difference.

Surpass own the servers - even dedicated - and it is their responcibility to keep them free of illegal material. If illegal material was found on the servers by feds it would be surpass that would bare the brunt of it.

You would have to immediately suspend that account and report it to Surpass. Who would then take the appropriate action. You however should not remove the offending file(s) without permission from surpass, they might want to confirm your find first. But suspension of the account would be the number 1 priority then contact surpass.

PS: Never download a file that you think is illegal to confirm its integrity. If you think a file is illegal you must report it to your local authority who will persue the checks for you under warrent. If you download the file you too have committed a crime. The same goes for Surpass, even if such a file was to reside on their server they too would by law have to have authorities carry out the check. Thats why the rules on files are so stressed.

Which just goes to further the theory that "bit-torrent" is much more likely to cause problems than solve them....

If there is only a 1% chance of walking safely through a mine field, would you take it?

someone mentioned that downloading the file is also a crime. incorrect. thousands upon thousands of lawyers have proven how it is not illegal to download a file. the illegal part is redistributing the said files. there has never been anyone charged for downloading anything, they are charged with giving them out, hosting the files. which is where the problem comes with the bit-torrent files.

Just thought I'd clarify that.

mhh..

i think that scott it's over reacting.. :headscrat it's not ilegal downloading from bittorrent, only the distribution is ilegal, and you know, the law in my country is no very clear about ilegal files(something that many take advantage).

Well, is evident, that because the servers are in USA, USA laws applies, but if i saw a suspicios file in one of my accounts, i will proceed to dowload. I not gonna make such a mess for something that i dont know if is ilegal or not.

AND IF SOMEONE WANNA ARREST ME, they will have to come to Chile, AND HERE IN CHILE WE DONT A LAW AGAINST ILEGAL FILE DOWLOADS...

I LOVE MY COUNTRY....

soo, from my point of view, i can host torrent files, if they are legal, and if any file is suspicius, i will dowload it..
