contracts, weeeee!

Hey boys and girls!
How many of you use an SLA and/or other contracts for when your clients enlist your web design or web hosting services? I'm talking about a written and signed (on the dotted line even!) contract (well, in person at least; digital sig/check box for online transactions), not just verbal agreements.

I did for my last web gig, however it was basically a school project. I would in any future instances though.

Three stage payment plan, FTW.

I do for graphic design. But i've had a large client go bankrupt so i got screwed.

An additional question, kind of a sub-question if you will: When assigning rights and ownership for web design work do you usually assign full ownership of the design (minus computer programs) to the client and reserve rights to showcase or portray in your porfolio, design competitions, marketing, etc? What are your habits with regards to this?

Yeah, I've always done as you said there... gave full ownership/copyright to the client, but preserved the right to display it in a portfolio. It's never come up in regards to design competitions or marketing, but primarily because my focus is more on development than design.

I haven't done solo work in over a year though.

One thing that I ran into with a job that was available was that the original designer and developer copyrighted the entire site and would not allow them to edit it. They had to pay or wait for him to do it. I don't know why they signed, totally screwed them over to the point they started looking for someone else to make something from scratch.

It is important to define this stuff though. Design is something you'd want to transfer, but you may only want to license the CMS or whatever you've developed for a backend.
